End User License Agreement

1. Acknowledgement

You acknowledge that this Agreement is between you and Simonara only — not with Apple Inc. or Google LLC — and that Simonara, not Apple or Google, is solely responsible for the Application and its content. The terms of this Agreement may not provide for usage rules less restrictive than, or in conflict with, the Apple Media Services Terms and Conditions and the Google Play Developer Distribution Agreement, which were in effect as of the date you obtained the Application.

2. Scope of License

Simonara grants you a non-transferable, non-exclusive license to use the Application on any device that you own or control, as permitted by the Apple Media Services Terms and Conditions and Google Play Terms of Service. The license is limited to:

• Personal, non-commercial use of the Application's gifting features.
• Use of the AI-powered features (Simon AI) for personal gift discovery.
• Sharing of features (Group Gifting, Vault sharing) within the Application's design.

You may not reverse-engineer, decompile, disassemble, or attempt to discover the source code of the Application, except as permitted by applicable law.

3. Consent to Use of Data

You agree that Simonara may collect and use technical data and related information (including non-personally identifiable information about your device, system, application software, and peripherals) to provide and improve the Application. See our Privacy Policy for full details.

4. User-Generated Content & Zero Tolerance

Simonara has zero tolerance for objectionable content or abusive behavior. You agree NOT to:

• Post or transmit hate speech, harassment, threats, sexually explicit content, or content that promotes violence.
• Impersonate any person or misrepresent your affiliation with any person or entity.
• Use the Application to spam, defraud, or solicit other users.
• Upload content that infringes any third party's intellectual property or privacy rights.

Violation of these rules may result in immediate content removal, account suspension, or permanent ban without notice. You can report objectionable content at any time — see the Report Content guide. Reports are reviewed within 24–48 hours.

5. Services & Subscriptions

Certain features ("Simonara Pro") are available as auto-renewing subscriptions billed through Apple's App Store, Google Play, or our web payment processor (Stripe). Pricing, renewal terms, and cancellation procedures are governed by the relevant platform's terms. You may cancel anytime; refunds are at the platform's discretion.

6. Warranty Disclaimer

The Application is provided "AS IS" without warranty of any kind. Simonara disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. Gift recommendations are generated by AI and provided for inspiration — final purchasing decisions are entirely your responsibility.

7. Limitation of Liability

To the maximum extent permitted by law, Simonara is not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Application, including loss of data, lost profits, or business interruption.

8. Product Claims

You and Simonara acknowledge that Simonara — not Apple Inc. or Google LLC — is responsible for addressing any claims relating to the Application or your possession and/or use of the Application, including: (i) product liability claims; (ii) any claim that the Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.

9. Intellectual Property Rights

In the event of any third-party claim that the Application or your possession and use of the Application infringes that third party's intellectual property rights, Simonara (not Apple or Google) will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

10. Third-Party Beneficiary

You acknowledge that Apple Inc., Google LLC, and their respective subsidiaries are third-party beneficiaries of this Agreement, and upon your acceptance of this Agreement, Apple and Google will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary thereof.

11. Termination

This Agreement is effective until terminated by you or Simonara. Your rights under this Agreement terminate automatically without notice from Simonara if you fail to comply with any of its terms. You may also terminate by deleting the Application and your Simonara account at simonara.app/delete-account.

12. Governing Law

This Agreement is governed by the laws of the State of Delaware, United States, without regard to its conflict of law principles, except where such law is preempted by, or contrary to, applicable federal law.
